1. About us

These Terms and Conditions (the "Terms") apply to every purchase made on kaoskids.ca (the "Website"). The Website is operated by Kaos Kids Inc. ("Kaos Kids", "we", "us" or "our"), 38068 Cleveland Ave, PO Box 2257, Squamish, BC V8B 0B5. Phone: 604-892-5567. Email: [email protected].

2. Acceptance of these Terms

By using the Website or placing an order, you agree to these Terms. Our Shipping & Returns policy and our Privacy Policy form part of these Terms. Where the Shipping & Returns policy gives more specific details on shipping, delivery or returns, those details apply.

The version of these Terms posted on the Website when you place your order applies to that order.

3. Eligibility

To place an order, you must be of the age of majority in your province of residence (19 in British Columbia), or be using the Website with the involvement of a parent or guardian.

4. Customer accounts

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Please contact us right away if you believe your account has been used without your permission.

5. Products

We make every effort to describe and display our products accurately. Colours, sizes and packaging may vary slightly from what appears on your screen or as updated by the manufacturer.

Some products, including our clothing collections, are available in our Squamish store only and are not sold on the Website.

6. Pricing

All prices on the Website are in Canadian dollars and are shown before applicable taxes. As required by Canadian law, sales taxes are charged based on the destination province.

Prices on the Website apply to online orders only and may differ from prices in our Squamish store. In store promotions are not valid online, and online promotions are not valid in store, unless stated otherwise.

If a product is listed at an incorrect price because of a typographical or system error, we may cancel the order before it ships or is picked up. If we do, we will let you know and refund any amount paid in full.

7. Stock availability

Our online store and our Squamish store share the same inventory. Because items also sell in store, a product shown as available online may sell out before your order is processed.

If an item in your order is no longer available, we will contact you. We may offer a similar item, or cancel that item and refund you in full for it.

8. Orders and payment

Your order is an offer to purchase. We accept your order when we confirm that it is ready for pickup, ready for delivery, or has shipped. We may decline or cancel an order, for example if a product is unavailable, a price is incorrect, or we suspect fraud. If we cancel, you receive a full refund of any amount paid.

We accept Visa, Mastercard and American Express on the Website.

9. Pickup, local delivery and shipping

We offer free in store pickup in Downtown Squamish, local delivery within Squamish, and flat rate shipping to British Columbia and Alberta. Current rates, minimums and delivery areas are listed on our Shipping & Returns page.

• In store pickup: please allow up to 2 days for processing. We will email you when your order is ready. Photo ID is required at pickup.
• Local delivery: please allow up to 2 days for processing. We will contact you to arrange delivery. Photo ID is required at delivery.
• Shipping: we currently ship to British Columbia and Alberta only, and do not ship to the United States. Contact us for a quote to other provinces. Orders are usually sent by Canada Post and must meet Canada Post size and weight limits.
• Heavy and bulky items (such as play kitchens, doll houses and easels) are excluded from shipping offers and require a separate delivery quote.

Delivery times are estimates and are not guaranteed. Delays caused by events outside our control, such as weather, postal disruptions or pandemics, may occur.

10. Returns

Unused items may be returned within 14 days of receipt, in saleable condition, with unopened packaging and the original receipt. All returns require prior email authorization. Shipping charges are not refunded, and return shipping is the customer's responsibility, except where Kaos Kids made an error.

Damaged, final sale and discontinued items cannot be returned. For hygiene and safety reasons, some product categories are final sale. The full list is on our Shipping & Returns page.

11. Your rights under British Columbia law

Online purchases are distance sales contracts under British Columbia's Business Practices and Consumer Protection Act. Nothing in these Terms limits the rights that law gives you, including the right to cancel an order in certain cases, such as when goods are not delivered within 30 days of the promised delivery date. If you cancel under that law, we will refund you as the law requires.

12. Warranty

Products are covered by the individual manufacturer's warranty and return policy. Items showing excessive wear or damage from misuse are not covered. If you receive a faulty product, please email us and we will do our best to help. Nothing in this section limits any warranty or condition that cannot be excluded under British Columbia law.

13. Product use and safety

Please follow the manufacturer's age recommendations, instructions and warnings for every product. Children should be supervised when using toys and products as the manufacturer advises. Product recalls in Canada are published by Health Canada.

14. Limitation of liability

To the extent permitted by law, Kaos Kids is not liable for indirect or consequential losses arising from the use of the Website or our products. Our total liability for any order is limited to the amount you paid for that order. Nothing in these Terms excludes liability that cannot be excluded under British Columbia law.

15. Privacy

We collect and use your personal information only as described in our Privacy Policy, in line with British Columbia's Personal Information Protection Act.

16. Email communications

We will send emails needed to process your order, such as confirmations and pickup notices. We will only send marketing emails if you have agreed to receive them, as required by Canada's anti spam legislation. You can unsubscribe at any time using the link in any marketing email.

17. Website content

All text, images, logos and other content on the Website belong to Kaos Kids or its suppliers and may not be copied or used without permission.

18. Governing law

These Terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. Any dispute will be handled by the courts of British Columbia or, where it applies, the BC Civil Resolution Tribunal.

19. Changes to these Terms

We may update these Terms from time to time. Changes apply to orders placed after the updated Terms are posted.
